Terms and Conditions for A2P Compliance

1. Introduction These Terms and Conditions ("Terms") govern the use of Application-to-Person (A2P) messaging services within our website ("Website"). By utilizing A2P messaging, you ("User") agree to comply with these Terms, along with all applicable laws, carrier regulations, and industry guidelines.

2. Compliance with Regulations Users must adhere to all relevant laws and regulations regarding A2P messaging, including but not limited to:

  • The Telephone Consumer Protection Act (TCPA)

  • The CAN-SPAM Act

  • The Cellular Telecommunications Industry Association (CTIA) Guidelines

  • Carrier-specific rules and guidelines

  • Any additional regulatory requirements imposed by governing bodies

3. Registration and Approval Users engaging in A2P messaging must register their messaging campaigns through the required channels, including The Campaign Registry (TCR), where applicable. Unregistered or non-compliant messaging may result in message blocking or service suspension.

4. Consent and Opt-in Requirements Users must obtain explicit opt-in consent from recipients before sending any A2P messages. Proof of consent must be retained and provided upon request. Opt-in mechanisms may include:

  • Web forms with affirmative user actions

  • Keyword-based SMS subscriptions

  • Written agreements or electronic acceptance

5. Opt-out and Unsubscribe Compliance All A2P messages must include a clear opt-out mechanism, allowing recipients to unsubscribe from further communications. Users must honor opt-out requests immediately and ensure that the recipient no longer receives messages after opting out.
 

6. Message Content Restrictions Users must ensure that all A2P messages comply with carrier guidelines and refrain from sending prohibited content, including but not limited to:

  • Spam, phishing, or deceptive messages

  • Hate speech, violence, or illegal activities

  • Adult, gambling, or restricted financial services

  • Misleading or fraudulent promotions

7. Monitoring and Enforcement We reserve the right to monitor A2P messaging activity for compliance. Violations of these Terms may result in:

  • Message filtering or blocking

  • Account suspension or termination

  • Legal or regulatory action, where applicable

8. Liability and Indemnification Users acknowledge that they are solely responsible for their A2P messaging activities. Users agree to indemnify and hold harmless our Website, its affiliates, and service providers from any claims, damages, or penalties arising from non-compliance with these Terms.

9. Modifications to Terms We reserve the right to update these Terms at any time. Continued use of A2P messaging services constitutes acceptance of the modified Terms.
